2. Nature of the Service

DisClaw provides remote access to physical amusement machines (claw machines) for entertainment. While prizes may be awarded, the outcome is intended to be primarily influenced by player skill, including timing and positioning, within normal mechanical tolerances.

Important: The Service is not a casino or wagering platform. No cash, gift cards, or cash equivalents are awarded.

3. Service Availability & Downtime

DisClaw operates as a home-based service and is currently managed by a single operator. As such, the bot may only be available during specific hours determined by operational capacity and resource availability. Users acknowledge that the Service may be offline, partially functional, or unavailable outside these hours.

Due to the home-based setup and limited staffing, technical issues including software crashes, connectivity interruptions, or mechanical problems may occur. While every effort is made to maintain functionality, these issues may not be resolved immediately. Users accept that credits will not be refunded for temporary downtime or technical interruptions, except for in the case of interrupted gameplay resulting in lost credits.

Users are encouraged to check whether or not the bot is running, and understand that uptime may vary based on maintenance, updates, or unforeseen circumstances.

5. Credits Refund for Unfair Gameplay

DisClaw strives to ensure all gameplay setups provide a fair opportunity to win. A setup is considered fair if the total number of credits spent to win a prize does not exceed three (3) times the original purchased price value of the prize.

In the event that a user believes they have spent more than the fair amount of credits on a prize, they may submit a request to DisClaw support for credit reimbursement up to the amount exceeding the three-times threshold. Requests must include the relevant session details and be submitted within 48 hours of the affected session.

Refunds, if granted, will be applied as credits to the user’s account and do not constitute cash compensation. DisClaw reserves sole discretion to determine whether a gameplay session meets the criteria for credit reimbursement.

Refunds for Artistic & Creative Services

Due to the nature of artistic services offered through partnered creators of DisClaw, monetary refunds are not offered. For prizes or rewards that involve custom art, creative work, or similar artistic services exchanged for points or credits, once an artist has begun work, delivered preliminary materials, or completed the service, the value of the service is considered rendered and cannot be fully reversed.

Refunds, partial refunds, or alternative compensation aside from the 3x overpay clause may only be issued under the following conditions:

The original artist explicitly agrees to a refund, or The artist proposes alternative terms, such as a partial refund, revision, or replacement service.

DisClaw acts solely as a facilitator between users and contributing artists and does not have the authority to override an artist’s decision regarding refunds for completed or in-progress creative work.

By redeeming points or credits for artistic or creative services, users acknowledge and accept these limitations.

6. Promotional Credits & Alternate Methods of Entry

From time to time, DisClaw may distribute promotional bonuses or credits through marketing campaigns, loyalty offers, or other discretionary programs. Availability, eligibility, and amounts may vary and are not guaranteed.

Alternate Method of Obtaining Credits (No Purchase Necessary)

In compliance with applicable promotional and sweepstakes regulations, DisClaw provides an alternate method of obtaining gameplay credits without purchase. Eligible users may submit a written request via email to info@disclaw.us using the subject line “Credit Request”. Valid requests may receive one (1) complimentary gameplay credit per week. Requests are processed in the order received and may be subject to verification, account status review, rate limits, and fair-use restrictions. Duplicate, incomplete, automated, or fraudulent requests may be rejected. DisClaw may modify or discontinue this method where permitted by law.

Complimentary credits, when issued, function identically to paid credits and provide the same chance of winning.

You agree to use the Service in compliance with all applicable local, state, federal, and international laws. DisClaw operates as a skill-based amusement service and, where required, provides a free alternate method of entry as described in Section 5.

Certain jurisdictions restrict prize value, eligibility, or gameplay mechanics. Use of the Service in prohibited jurisdictions is not permitted.

10a. Pre-Dispute Arbitration

By accessing or using the Service, you acknowledge and agree that any and all disputes, claims, or controversies arising out of or relating to these Terms or your use of the Service shall be resolved exclusively through binding arbitration. You hereby waive any right to bring a lawsuit in court or participate in a class-action, representative, or consolidated proceeding. Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) or another mutually agreed arbitration provider. By agreeing to these Terms, you consent to this process and give up the right to pursue any judicial remedy except as required by law.

If you initiate any lawsuit in violation of this arbitration agreement, you agree that such action is improper and you may be held responsible for all reasonable legal fees, costs, and expenses incurred by DisClaw in enforcing this arbitration provision.

If a dispute cannot be resolved informally by contacting DisClaw support within 30 days, it may then proceed to arbitration. This agreement applies to all claims, including statutory claims, to the extent permitted by law.

11. Privacy

Your use of the Service is also governed by our Privacy Policy (available on the website). We collect, use, and store personal information in accordance with that policy and applicable law.

12. Limitation of Liability

To the fullest extent permitted by law, DisClaw and its owners, affiliates, and employees will not be liable for indirect, incidental, special, consequential, or exemplary damages, including loss of data, loss of prizes caused by third-party carriers, or downtime/technical issues. Aggregate liability for direct damages will not exceed the total amount you paid for credits in the three (3) months preceding the event giving rise to the claim.

13. Termination

We may suspend or terminate access to the Service at any time for violations of these Terms, suspected fraud or abuse, or to comply with legal obligations. Upon termination, remaining credits may be forfeited unless required by law.

14. Changes to Terms

We may update these Terms from time to time. The “Last Updated” date will reflect the latest changes. Continued use of the Service after changes become effective constitutes acceptance.

15. Branding, Name & Visual Identity

DisClaw is an original project with its own independent branding, name, visual identity, and design language. While certain colors, layouts, or stylistic elements may appear similar by common design trends used across the inspired platform, DisClaw does not claim, imply, or represent any affiliation with Discord Inc. or any other third party.

The DisClaw name, logo, iconography, color palette, and overall presentation are used solely to identify this Service and distinguish it from other products or platforms. Any similarity to third-party branding does not indicate sponsorship, endorsement, or official association.

All third-party trademarks, service marks, trade names, logos, and brand references remain the property of their respective owners. DisClaw makes no claim of ownership over such third-party intellectual property and uses no protected assets belonging to Discord Inc., including but not limited to official logos, proprietary icons, or copyrighted interface elements.

Clarification: DisClaw does not use official Discord logos, assets, or proprietary branding materials. Color usage alone does not constitute affiliation or endorsement.

By using the Service, you acknowledge that DisClaw operates independently and that branding similarities do not imply any official relationship.
